The reason Eminem is taking legal action against Mark Zuckerberg’s Meta for $100 Million

Eminem, the best-selling artist of all time rap artist, and one of the most successful musicians of all time, is taking action in a court of law against Meta, the owner of Facebook and Instagram, due to the use of his copyrighted materials without his consent. The lawsuit, which demands $100 million in compensation for losses, states that Meta utilized Eminem’s music in a promotional campaign for Instagram without authorization.

The Lawsuit Explained

In the lawsuit, it is alleged that Facebook, i.e., the holding company of Instagram, committed copyright infringement by using the musical composition of Eminem without the proper licensing in the Instagram Reels ad. The advertisement that was the background was a speech from one of Eminem’s hits that promoted Instagram’s short-video feature.

Eminem’s lawyers say that Zuckerberg and his team manipulated their position to trespass on their rights and used their track illegally, thus they are in breach of copyright law. In the set of papers, the complainants expand the argument by revealing that the company does not limit itself to mere breaches: it “appropriates [Eminem’s] creative work for its commercial purposes”, being thus on the one hand, indemnity and on the other, an injunction.

Meta’s History with Copyright Issues

Meta has been here before with legal disputes over song rights. The munificence of that tech giant has been drawn on by artists and record companies for the similarity of the series of cases that come out of them. Eminem’s is, however, the celebrity case for the artist, and the size of the gouging being sought.

Eminem’s Strict Stance on Copyright

Marshall Mathers, the creator of the brand Eminem, has been, and still is, very protective of his music and brand. He resolved those issues legally when it was found out that his works were used without his permission by those entities. The same people who run political campaigns and advertisements are therefore the ones that they have to fight against if they want to get the rights to use the artists’ work. Eminem’s legal team is known for vigorously pursuing copyright infringers, hence why this case may be a big challenge for Meta.

What’s Next?

In the case of the trial, it may become the basis of future decisions on how social networks shall regulate the use of copyrighted music in advertisements. However, Meta hasn’t made any statement about this issue, although, according to lawyers, the company might decide to negotiate and avoid the lengthy litigation.

At the moment, this lawsuit filed by Eminem for $100 million is a very clear and loud message sent to corporations that they will be held responsible for the use of artists’ work without their consent.
